Service These terms and conditions govern the provision of long distance services by Save4Less and its affiliate, Mainstreet Telephone Company. Please also review the terms and conditions for free airline tickets and/or free hotel nights and/or free cruise, $100 travel cash, and the It's On Us customer rewards program. Eligibility for the Save4Less calling plan is restricted to pre-approved local exchange carrier outclearing areas only. If you are not in one of these areas, your registration will not be confirmed. You must be 21 years of age or older and authorized to incur charges on the telephone number provided when you sign up for service. Save4Less' services may be used solely for lawful purposes. Customer agrees to indemnify and hold the company harmless from any claims resulting from customer's use of this service. At their sole discretion, Save4Less may revoke a customer's access for inappropriate or abusive usage. Customers acknowledge their agreement to these Terms of Service when they sign up for service through the Save4Less web site or the web site of one of its marketing partners. Save4Less may change these Terms of Service at any time by posting such changes to the web site located at http://www.save4less.com/. Therefore, customers should periodically review the web site for such changes to these Terms of Service. Customers are entitled to claim only the premium as advertised on the registration page where they have enrolled for Save4Less. This advertised premium can not be combined with other offer. Limit one premium per household. If customer does not wish to continue to use the services due to a change in the Terms of Service, then such customer may cancel the services in accordance with the Cancellation Policy. By indicating agreement through an on-line order form the customer hereby agrees they have read and fully understand this disclaimer. The customer hereby agrees to be responsible for payment of all applicable charges incurred as a result of the use of the customer's Save4Less calling plan, including but not limited to the use or misuse by an unauthorized third party, or any error, accidental use or loss. Save4Less deems it necessary to monitor and control the services for the prevention of fraudulent use outside of our products' primary intent. It is necessary that Save4Less take these precautions in order to provide customers with the best service possible. Use of Service. Upon signing up for service, you will
be emailed a toll-free access number and Personal Identification
Number ("PIN"). To place a call using the Save4Less service,
call the toll-free access number, enter your PIN, and then dial the
number you want to call. Calls can be placed to any destination
in the Continental Fees and Billing. A monthly charge of $13.90 will appear on your local telephone
bill in the Miscellaneous Charges and Credits Section on USBI's page
as billing on behalf of Mainstreet Telephone Company. The $13.90
monthly charge covers 284 minutes of domestic long distance calling
within the Continental U.S. each month. Any additional minutes used beyond
the standard plan minutes and complimentary minutes will be billed
at the rate of $0.049 per minute. Fees for the calling plan are
billed to the respective local telephone number given by the customer.
The Fees will be charged to customer's local telephone bill on or close
to the anniversary of the date of such customer's account activation.
Customer is responsible for all taxes for the services and any increase
in the taxes will be passed on to the Customer. Calls made from a payphone
will incur a surcharge. There are no fees for activation,
connection charges, or cancellation. Cancellation Policy. Customer may cancel customer's account at any time upon telephone notice to 1-888-503-LESS (5377) or by sending a cancellation email to info@save4less.com. If a cancellation request is received at least 10 days prior the start of the next month's service (beginning the day of the month the account was first activated), cancellation will be effective beginning with that next month's service. Otherwise, cancellation will be effective beginning with the following month's service. If a customer cancels an account more than 10 days prior to the monthly anniversary date, there are no further charges. The Customer acknowledges that their account's PIN will be deactivated once the cancellation has been accepted and processed by Save4Less, regardless, whether or not they have used all of the remaining allotted minutes for that month. Disclosure of Customer Information. Save4Less may disclose information regarding your use of the service to satisfy lawful governmental requests; operate, maintain or improve the service; or protect Save4Less, its subsidiaries, clients and customers against criminal and civil liability. Waiver and Limitations on Liability. CUSTOMER WAIVES ANY AND ALL CLAIMS AND CAUSES OF ACTION CUSTOMER NOW HAS OR MAY HAVE IN THE FUTURE AGAINST SAVE4LESS, IN ANY WAY FROM SAVE4LESS INITIATING OR PARTICIPATING IN ANY SERVICE RELATED ISSUE OR FROM THE AUTOMATIC CHARGING TO THE CUSTOMER'S LOCAL TELEPHONE BILL. IN THE EVENT SAVE4LESS BREACHES THIS AGREEMENT AND CUSTOMER IS DISSATISFIED WITH THE SERVICES, CUSTOMER'S SOLE REMEDY IS TO DISCONTINUE THE SERVICES. SAVE4LESS' SOLE LIABILITY IN THE EVENT SERVICES ARE NOT AVAILABLE FOR MORE THAN A 24 HOUR PERIOD SHALL BE LIMITED TO A REFUND OF THE SERVICE FEES PAID FOR THE AFFECTED TIME PERIOD. IN NO EVENT SHALL SAVE4LESS BE LIABLE FOR ANY DAMAGES, INCLUDING DIRECT, INDIRECT, SPECIAL OR CONSEQUENTIAL, PUNITIVE OR EXEMPLARY DAMAGES. Disclaimer of Warranties. SAVE4LESS MAKES NO WARRANTIES AND EXPRESSLY DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, WITH RESPECT TO THE SERVICES, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. |
